The person(s) whose signature(s) appear on this contract, known as “client,” agree that FLASH AND FRAME 0950206 BCLTD will provide photobooth services to the best of his abilities, in the manner described in this document. This is a binding contract, which incorporates the entire understanding of the parties, and any modifications must be in writing, signed by both parties, and physically attached to the original agreement.

Pursuant to the responsibilities of the Client, FLASH AND FRAME 0950206 BCLTD agrees to have a photobooth operational for a minimum of 75% during this period; occasionally, operations may need to be interrupted for maintenance of the photobooth.

If a client arranges an early set up time with Flash and Frame Photobooth, the equipment once left at venue is now under the safety and responsibility of the client. The client assumes any liabilities with loss, damages and delay of start time if the booth is tamped with, misused or moved. In  such circumstances that this would  occur the client assumes loss of service while the attendant repairs, relocates and/or fixes the photobooth. If the photobooth is no longer able to function the client relinquishes the service as well is liable for damages and or loss.

A non-refundable retainer in the amount of $250 is due upon signing of contract. The remaining amount is due 30 days in advance of Client’s Event. If paying by credit card, Client agrees to have FLASH AND FRAME 0950206 BCLTD charge Client’s credit card for payment of services. Client is liable for any overage in time at the cost of $100/hr, which will be billed in half hour increments. Client agrees that in addition to any and all other legal rights and remedies FLASH AND FRAME 0950206 BCLTD may have, Client will pay a $50 fee for any and all returned checks which Client may write to LAURA MCCALLUM AND/OR FLASH AND FRAME 0950206 BCLTD as payment for services.

Any request for a date, time, or location change must be made in writing at least thirty days in advance of the original event date. Change is subject to photobooth availability and receipt of a new Service Contract. If there is no availability for the alternate date, time, or location, deposit shall be forfeited and event cancelled. Any cancellation occurring less than thirty days prior to the event date shall forfeit all payments received.

Client shall provide parking for FLASH AND FRAME 0950206 BCLTD’S vehicle while at Client’s Event. Access, Space, and Power for Photobooth Client will arrange for an appropriate space for the Photobooth at Client’s venue. Space must be level, solid, and at least 6’ by 9’. It is the Client’s responsibility to ensure access is possible. Photobooth may be placed in an exterior location, provided it is protect from weather. Client is responsible for providing power to the Photobooth (110V, 10 amps, 3 prong outlet).

This contract serves as a model release giving the FLASH AND FRAME 0950206 BCLTD the right to use the photographs in all forms and all media in all manners, including but not limited to his blog and portfolio page. ONLINE GALLERY Upon receiving downloadable link for high-resolution files, client accepts all responsibility for archiving and protecting the photographs. FLASH AND FRAME 0950206 BCLTD is not responsible for the lifespan of any digital media provided for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is the Client’s responsibility to make sure that digital files are copied to new media as required.

Client hereby indemnifies and holds harmless FLASH AND FRAME 0950206 BCLTD Owner and its employees as to any and all injuries and/or accidents of client and guests relating to Photobooth use and supply of materials/equipment at the time of the event.

FLASH AND FRAME 0950206 BCLTD will design a print out based on material supplied by Client, including logos, fonts, monograms, and ideas. FLASH AND FRAME 0950206 BCLTD will provide a draft and one revision, additional revisions will be billed to Client at ($100) an hour.   WIFI FLASH AND FRAME 0950206 BCLTD social media package requires Client to provide or guarantee a venue Internet connection of at least (1MB). FLASH AND FRAME 0950206 BCLTD. is not responsible for insufficient social media features below the required Internet speed.  

In the event the FLASH AND FRAME 0950206 BCLTD is unable to supply a working Photobooth for at least 75% of the Service period, Client shall be refunded a prorated amount based on the amount of service received. If no service is received, FLASH AND FRAME 0950206 BCLTD ‘S maximum liability will be the return of all payments received from Client. FLASH AND FRAME 0950206 BCLTD is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
Prior to the Event the CLIENT {{answer_11157847}}will provide a FLOORPLAN to show the designated photobooth set up location. For events where we set up early our equipment is not to be touched, moved or tamped with. If there is a scenario where equipment is to be moved the client and or venue is responsible for making contact with Flash and Frame via telephone. ( Number is always placed on equipment boxes and photobooth ). If equipment is moved, tamped with or touched we do not guarantee our planned start time and will not extend the service period for the extended moving services.  All timelines are  final upon confirmation email.

Client understands and agrees that all sales and service fees are final.
